Signing Your Documents

Whether you are buying or selling a home, a typical real estate transaction will involve many documents, disclosures and reports which you will need to review and sign in a timely manner as you receive them. You may receive documents and reports that you may not fully understand. If this is the case it is strongly recommend that you DO NOT sign them until you go over them with your agent or legal counsel for clarification so that you fully understand what you are signing.


Below are just some of the various types of document categories:

Property listing
  • MLS listing documents to put the property on the market for sale
  • HOA authorization forms (If your property is located in a Homeowner Association development, the HOA will need to authorize the type of sign which can be placed on the property and its location within the complex and the location where to install the key box.

If you are a buyer obtaining a mortgage loan – Below are just some of the various types of documents that you will be receiving, reviewing and signing:

Loan Disclosures

  • Loan Estimate
  • Anti-Steering disclosure of loan options
  • Per-diem interest affidavit
  • Loan quality initiative disclosure
  • Credit score disclosure
  • Borrower loan options
  • First payment letter
  • General disclosure notices
  • Right to cancel

If you will be obtaining an FHA or VA mortgage loan, there will also be additional disclosures.


At your initial meeting with your agent, you will normally discuss how you wish to receive your transaction documents, disclosures, reports, etc. You may choose one or more of the following ways in which you wish to receive, review, sign and send back the documents, so be sure to let your agent know what you prefer.

Options on how to receive, review and sign your documents
  • Electronically – Receive, review, download PDF files to save on your computer or mobile device and E-sign documents directly on your computer or mobile device from a secured system. (See note 2)
  • Fax – Receive, review, sign and send back documents via fax or by mailing documents back.
  • E-mail – Receive, review, sign and either scan the documents and email back (or send back via regular mail). Note: When E-mailing documents back – Always be sure to password protect each attached document file.
  • Regular mail – Receive, review, sign and mail documents back.

When you’re buying or selling a house, you often have to move quickly. No problem. As long as you have an internet connection, you can electronically sign real estate documents from anywhere. E-sign documents on a mobile phone, tablet, or laptop at home, from the gym, or anyplace!

As you can see, there are many important documents involved in a real estate transaction and here at Aiello & Associates, we want to make sure you fully understand everything that you are signing, and we will be with you and assisting you from start to finish.


Notes:
1) For documents that are not directly related to real estate or mortgage (such as City/County zone reports, specialty inspection reports, etc.) we recommend that you contact the originator of the document to ask for clarification.

2) For Electronic document signing we use Authentisign (3rd party service).
