Forms you will need to sell your home
Here are some of the most common and important forms and information you will need:
Purchase Agreement:
The agreement between you and the buyer on terms and conditions of sale.
Purchase Agreement contingency clauses: In addition to the purchase agreement, you may need to add one or more attachments to the agreement to address special contingencies – such as the buyer’s need to sell a home before purchasing yours, your need to find a replacement home, etc.
Property disclosure forms: The “Seller Property Questionnaire” and “Real Estate Transfer Disclosure Statement” are required so that you can reveal all known defects regarding your property.
Purchaser’s access to premises agreement:
This agreement sets conditions for permitting the buyer to enter your home for activities such as measuring for draperies before you move.
Pre- and post-occupancy agreements:
Unless you’re planning on moving out and the buyer moving in on the day of closing escrow, you’ll need an agreement on the terms and costs of occupancy once the sale closes. If you should require remaining in your home after close of escrow (past 3 days) due to your relocation, job transfer, etc. then you would need to arrange this with the buyer (before close of escrow). Depending on the length of your stay, one of the following forms would have to be fully executed by your and the buyer:
- Seller in Possession Addendum (for up to 30 days occupancy)
- Residential Lease After Sale (for 30 or more days occupancy)
Lead-based paint disclosure pamphlet:
If your home was built before 1978, you must provide the pamphlet to all sellers. You must also have buyers sign a statement indicating they received the pamphlet.
